Terms of Use
These Terms of Use (the “Terms”) constitutes a binding agreement between Aqua-Aston Hospitality, LLC (“AAH”) and you concerning your use of aquaaston.com (the “Site”). By visiting the Site, you accept these Terms. If you do not wish to be bound by these Terms, do not use the Site.
AAH (“we,” “our,” or “us”) is an indirect subsidiary of Marriott Vacations Worldwide Corporation (“MVWC”) which is a global vacation company that offers vacation ownership, exchange, rental, and resort and property management, along with related businesses, products and services. These Terms do not apply to websites operated by other MVWC subsidiaries. Each subsidiary uses a different terms of use/service and we refer you to each website’s terms for more details.
License to Use the Site
AAH grants you a limited, non-exclusive license to access and view content on the Site for your own personal, non-commercial purposes. This license is personal to you and may not be assigned or sublicensed to anyone else. Except as expressly permitted by AAH in writing, you may not distribute, modify, transmit, reproduce, download, or use the content of the Site for public or commercial purposes, including the text, images, audio, and video without AAH’s written permission. Nor will you take any measures to interfere with or damage the Site. All rights not expressly granted by AAH are reserved.
Other than information regarding hotel accommodations, all information provided on the site including, but not limited to, Vacation Inspiration, Activities, Best Of, Itineraries, Themes and Spotlights, and information regarding activities, food, site-seeing, landmarks, things-to-do, and our favorites, are provided solely for informational purposes as a convenience to you. This information in no way indicates Aqua-Aston’s endorsement, recommendation, support or approval of the content or of the products, activities, services or operators referenced. Your decision to engage in any activity based upon the information provided on the site is at your own risk. Aqua-Aston is not responsible for any personal injury, damage or harm resulting from your use of or participation in any experience resulting from information on the site.
Privacy
Your privacy rights are set forth in our Privacy Policy, which forms a part of these Terms. Please review the Privacy Policy to learn about what information we may collect about you, how we use it, and with whom we share it.
Images
Images of people or places displayed on the Site are either the property of, or used with permission by, AAH. The use of these images by you, or anyone else authorized by you, is prohibited unless specifically permitted by these Terms. Any unauthorized use of the images may violate copyright laws, trademark laws, the laws of privacy and publicity, and regulations and statutes.
Trademarks
The trademarks, logos, and service marks (collectively the "Trademarks") displayed on the Site, are registered and unregistered Trademarks of AAH and others. Nothing contained on the Site should be construed as granting, by implication, or otherwise, any license or right to use any Trademark displayed on the Site without the written permission of AAH or such third party that may own the Trademarks displayed on the Site. Your misuse of the Trademarks displayed on the Site, or any other content on the Site, except as provided in these Terms, is strictly prohibited. You are also advised that AAH will enforce its intellectual property rights to the fullest extent of the law, including the seeking of criminal prosecution.
Claims of Copyright Infringement on the Site
Under the Digital Millennium Copyright Act of 1998 (the "DMCA") if you believe in good faith that any content on the Site infringes your copyright, you may send us a notice requesting that the content be removed. The notice must include: (a) your (or your agent's) physical or electronic signature; (b) identification of the copyrighted work on our Site that is claimed to have been infringed (or a representative list if multiple copyrighted works are included in one notification); (c) identification of the content that is claimed to be infringing or the subject of infringing activity, including information reasonably sufficient to allow us to locate the content on the Site; (d) your name, address, telephone number and email address (if available); (e) a statement that you have a good faith belief that use of the content in the manner complained of is not authorized by you or your agent or the law; and (f) a statement that the information in the notification is accurate and, under penalty of perjury, that you or your agent is authorized to act on behalf of the copyright owner. If you believe in good faith that a notice of copyright infringement has been wrongly filed against you, you may send us a counter-notice. There can be penalties for false claims under the DMCA. We suggest that you consult your legal advisor before filing a notice or counter-notice. It is our policy to terminate, in appropriate circumstances, the access rights to the Site of repeat infringers.
AAH may at any time revise these Terms by updating this posting. You are bound by any such revisions and should therefore periodically visit this page to review the then current Terms to which you are bound.
